Terms of use
These terms govern your use of the OraForge Tech Company website at oraforgetech.com. Software projects and consulting engagements are governed by a separate signed agreement.
Last updated 29 July 2026
These pages describe how OraForge Tech Company operates this website. They are not a substitute for legal advice on client engagements — project work is covered by a signed agreement.
Agreement
By accessing this website you agree to these terms and to our Privacy policy and Cookie policy. If you do not agree, do not use the site.
We may update these terms from time to time. The version published on this page on the date you visit is the version that applies.
Who we are
This website is operated by OraForge Tech Company, a software studio based in Nairobi, Kenya. Contact: hello@oraforgetech.com.
Using this site
You may browse the site, share links to public pages, and contact us through the forms provided for genuine business enquiries.
You must not misuse the site — including attempting to disrupt it, probe it without authorisation, scrape it at a volume that harms performance, submit malicious content, or use it to send spam.
You may not copy the site’s content wholesale, present our writing or case studies as your own, or use site materials to train commercial machine-learning models for redistribution without our prior written permission.
No offer; accuracy
Content on this site — including service descriptions, timelines, technologies, and illustrative case studies — is for information only. It is not a quotation, tender, or offer capable of acceptance.
We take care to keep the site accurate, but we do not warrant that every page is complete or current. Pricing and scope are confirmed only in writing after discovery.
Enquiries and communications
When you send an enquiry, you confirm that the details you provide are accurate and that you are authorised to discuss the project on behalf of the organisation named, if any.
We aim to reply within two working days (Kenya time). An acknowledgement or reply is not a commitment to take on the work.
Client engagements
Delivery of software, design, cloud, or related services is governed by a signed statement of work, proposal, or master agreement covering scope, fees, intellectual property, confidentiality, warranties, and liability.
Where those documents conflict with these website terms, the signed engagement documents prevail for that work.
Our standard commercial position is that you own the custom source code and project artefacts we produce for you under a paid engagement, from delivery of that work, subject to payment and any third-party or open-source licences that apply. Pre-existing OraForge tools, libraries, and know-how remain ours unless expressly assigned.
Intellectual property
The OraForge name, marks, logo, site design, and original content are owned by OraForge Tech Company or its licensors. You may not use our marks without written permission, except for honest nominative reference.
Third-party product and technology names appearing on this site belong to their respective owners and are used only to describe tools we work with.
Third-party links
The site may link to external sites. We are not responsible for their content, privacy practices, or availability. Following a link is at your own risk.
Disclaimer of warranties
The website is provided “as is” and “as available.” To the fullest extent permitted by Kenyan law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement regarding the site itself.
This disclaimer does not affect warranties expressly given in a signed client agreement for project work.
Limitation of liability
To the extent permitted by law, OraForge is not liable for any indirect, incidental, special, consequential, or punitive loss, or for loss of profits, data, or business opportunity, arising from your use of or reliance on this website.
Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be limited under Kenyan law.
Governing law
These terms are governed by the laws of Kenya. The courts of Kenya have exclusive jurisdiction over disputes arising from these terms or your use of the website, without prejudice to any mandatory consumer protections that may apply in your country of residence.
